01 · The parties
"We" is the operator of ASOScan, based in Germany. "You" is the person or company using the service. Polar is our payment processor and is the legal seller of the subscription.
These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and Khalil Kitar, an Einzelunternehmer (sole proprietor) trading as ASOScan, with registered operating address at Messeler-Park-Straße 132a, 64291 Darmstadt, Germany ("ASOScan", "we", "us", "our"), governing your use of the website at asoscan.com and the related application and APIs (together, the "Service"). Full operator details are set out in our Impressum.
Subscriptions to the Service are sold by Polar Software Inc. ("Polar") acting as merchant of record. Polar is the legal seller and issuer of invoices, is responsible for collecting and remitting applicable sales and value-added taxes, and appears on your bank or card statement as the merchant. The Service itself is provided by ASOScan.
02 · Acceptance
By using ASOScan you agree to this contract. If you don't agree, don't use it. If you sign up for a company, you confirm you have the authority to bind it.
By creating an account or otherwise using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you accept these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity. You must be at least 16 years of age, or the age of digital consent in your jurisdiction if higher, to use the Service.
03 · Account
One account per person or organisation. Keep your password safe. You are responsible for activity on your account.
You must provide accurate information when registering and keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised use. We may suspend or terminate accounts created with false information or used in violation of these Terms (see Section 12).
04 · What you get
App tracking, keyword monitoring, ASO scores, AI suggestions, competitor analysis, alerts, and reporting — within the limits published on the pricing page.
ASOScan provides app store optimization analytics, including app metadata tracking, keyword rank monitoring, ASO scoring, competitor analysis, AI-assisted metadata and keyword suggestions, alert rules, and PDF reporting. The specific features and quotas available to you depend on your subscription plan as published on the pricing page, which is incorporated into these Terms by reference.
05 · Free trial
Every plan includes a 14-day trial with full Pro-tier capacity. No credit card needed. When the trial ends, product features lock — but you can still log in to download your data or subscribe. Accounts left untouched for 90 days after lockout are deleted automatically.
Every plan includes a 14-day free trial that grants you access at the Pro-tier capacity. We do not require a payment method to start the trial. We will email you reminders five days, three days, and on the day before the trial ends.
At the end of the trial, the Service requires an active paid subscription to continue using product features. If you do not subscribe, your account enters a locked state in which you can still log in, view your billing settings, subscribe at any time, and download a complete export of your data, but cannot use product features such as keyword tracking, AI generation, or reporting.
Accounts that remain in this locked state for ninety (90) days without subscribing or being self-deleted are deleted automatically by a scheduled cleanup process, following the same procedure as a user-initiated deletion (see Section 11 and Section 06 of the Privacy Policy). We will email you a final reminder before automatic deletion takes place.
We reserve the right to limit free trials to one per person or organisation and to decline trials where there is reasonable evidence of abuse.
06 · Subscription & billing
You pay Polar monthly or annually in advance. Prices are on the pricing page. We can change prices with 30 days' notice; you can cancel before the change takes effect.
Paid subscriptions are billed by Polar on a recurring basis (monthly or annual, as you select at checkout) in advance. Prices are as published on the pricing page. All amounts are exclusive of VAT and other applicable taxes; Polar will calculate, collect, and remit VAT according to your billing country.
We may change prices for new billing periods with at least thirty (30) days' email notice. Price changes apply to the next renewal; you may cancel at any time before the renewal to avoid the new pricing.
Promotional discounts (including any "founding member" coupon) apply only to the term and conditions specified in the offer. Once a promotional term ends, the standard published price applies to subsequent renewals.
07 · EU right of withdrawal (consumers)
If you are an EU consumer (not a business) you have 14 days after subscribing to change your mind. By subscribing you agree we may start delivering the service immediately, which means once we have delivered it in full your right of withdrawal is no longer available.
If you are a consumer resident in the European Union, you have a statutory right under Directive 2011/83/EU and § 355 of the German Civil Code (BGB) to withdraw from a subscription within 14 days of conclusion without giving any reason.
Withdrawal instructions: to exercise this right, send an unambiguous statement (e.g. email to [email protected]) of your decision to withdraw within 14 days of subscribing. A model withdrawal form is available on request.
Important: by ticking the box at checkout to begin receiving the Service immediately, you expressly request that performance commences before the 14-day period expires and acknowledge that your right of withdrawal will be lost once the Service has been fully provided. Where the Service has been only partially provided at the time of withdrawal, you owe a proportionate amount for the part already delivered.
This section does not apply if you are entering this contract in a business or professional capacity.
08 · Acceptable use
Don't break the service, don't abuse the AI, don't use it for illegal stuff, don't try to scrape our scrapers.
You agree not to:
- Use the Service to violate any applicable law or third-party right.
- Attempt to gain unauthorised access to our systems, other accounts, or any underlying infrastructure.
- Reverse engineer, decompile, scrape, or copy the Service to derive its source data, except to the extent expressly permitted by mandatory law.
- Use AI generation features to produce content that is misleading, deceptive, infringing, harmful, or otherwise unlawful.
- Resell, sublicense, or operate a service derived from the Service without our prior written consent.
- Exceed the rate limits or usage quotas associated with your plan, or attempt to circumvent them.
- Use the Service to track apps in which you do not have a legitimate competitive or research interest.
09 · AI-generated content
The AI suggestions are starting points, not final answers. You're responsible for what you publish to the App Store or Play Store.
AI-assisted metadata, keywords, and recommendations are produced by third-party language models on the basis of inputs you provide. Outputs are provided "as is" without warranty of accuracy, fitness for purpose, or compliance with App Store or Play Store review guidelines. You retain full editorial responsibility for any content you publish to a third-party platform on the basis of AI suggestions generated by the Service. To the extent applicable copyright law permits us to do so, we assign to you any rights we may hold in AI outputs generated specifically from your inputs.
10 · Third-party data
App store data is scraped from public pages. We can't guarantee Apple or Google won't change their format and break things temporarily.
ASOScan retrieves publicly available metadata, ratings, and reviews from third-party app stores. We do not control these sources and cannot guarantee uninterrupted access, completeness, or accuracy. Changes to third-party APIs or page structures may cause temporary degradation; we will use reasonable efforts to restore service quickly.
11 · Cancellation & deletion
Cancel any time from settings. You keep access until the end of the billing period. Delete your account from settings and we wipe everything tied to your account within 30 days (subject to tax-required retention).
You may cancel your subscription at any time through the Polar customer portal accessible via the settings page. Upon cancellation you retain access to paid features until the end of the current billing period, after which your access is downgraded according to the applicable canceled-gate behaviour and the Privacy Policy retention rules.
You may delete your account entirely at any time from the settings page. Account deletion cancels any active subscription via Polar and removes every row in our database tied to your account — including the private copies of public app store data we collected on your behalf — within 30 days, subject to the retention exceptions described in Section 06 of the Privacy Policy.
12 · Suspension & termination by us
We can suspend or terminate your account if you break these terms, abuse the service, or fail to pay. We will give notice where the law requires it.
We may suspend or terminate your account, with or without notice as the circumstances warrant, if (a) you materially breach these Terms and do not cure the breach within a reasonable period after notice (where the breach is curable); (b) you engage in conduct that risks harm to other users, our infrastructure, or our reputation; (c) we are required to do so by law or by a competent authority; or (d) your subscription becomes more than 14 days past due. We will refund any pre-paid amounts for periods after termination except where termination is for material breach attributable to you.
13 · Warranties
The service is provided "as is". We do not promise specific business outcomes (more downloads, better rankings). Mandatory consumer warranties under EU law are not affected.
To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will be uninterrupted, error-free, or that any specific business outcome (such as increased downloads or rankings) will result from its use.
Nothing in these Terms excludes or limits any non-waivable statutory warranty granted to you as a consumer under the law of your country of residence, including warranties under the EU Sale of Goods and Digital Content Directives (2019/770 and 2019/771).
14 · Liability
If something goes wrong on our end, our maximum liability is what you paid us in the last 12 months. Liability for intent, gross negligence, life or bodily injury, or under mandatory consumer law cannot be limited.
To the maximum extent permitted by applicable law, in no event shall ASOScan, its affiliates, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, downloads, rankings, goodwill, or data, arising out of or in connection with the Service.
Our aggregate liability for any claim arising out of or in connection with the Service shall not exceed the amount you paid to us during the twelve (12) months preceding the event giving rise to the claim, or one hundred euros (€100) if no amount has been paid.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) intent or gross negligence; (c) fraud or fraudulent misrepresentation; (d) breach of mandatory provisions of the German Product Liability Act (Produkthaftungsgesetz); or (e) any other liability that cannot be excluded or limited under applicable law.
15 · Governing law & disputes
This contract is governed by German law. Disputes go to the courts of [city]. EU consumers can also use the European online dispute resolution platform.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict-of-law rules. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Darmstadt, Germany (Amtsgericht Darmstadt for matters within its competence, otherwise Landgericht Darmstadt), provided that you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law. For consumers, the mandatory consumer protection rules of the country in which you have your habitual residence apply in addition.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
16 · Changes to these Terms
If we change these terms in a meaningful way, we will email you at least 30 days in advance. You can cancel before they take effect.
We may update these Terms from time to time. Material changes will be communicated by email at least thirty (30) days before they take effect, and the version number and "Last updated" date in the document meta strip above will be incremented. If you do not agree to the updated Terms, you may cancel your subscription before they take effect. Continued use of the Service after a material change becomes effective constitutes acceptance.
